Prop 65 for Amazon Sellers: Protect Payouts When a Notice Arrives

Check exposure, warning placement, supplier evidence, and import records before a California Proposition 65 issue disrupts a listing or account.

Quick answer: Proposition 65 can require a clear and reasonable warning before a business knowingly and intentionally exposes a Californian to a listed chemical. For an online product, the safe-harbor method puts the warning, a clearly marked warning link, or another prominent warning on the product display flow before purchase. Confirm the chemical and exposure route; do not add, omit, or revise a warning from guesswork. This guide is operational information, not legal advice.

Prop 65 compliance checklist for Amazon sellers

Build the response file before you need it:

  • Map each ASIN to its supplier, materials, and test evidence.
  • Record who imports the product and retain customs entries.
  • Save the warning text, placement, and dated listing screenshots.
  • Preserve every notice and platform message without making admissions.
  • Escalate warning and notice decisions to qualified California counsel.

Start with the product, exposure, and business—not the label

California's Office of Environmental Health Hazard Assessment (OEHHA) explains that businesses must warn before knowingly and intentionally exposing someone to a listed chemical unless the business can show the anticipated exposure is below the applicable risk threshold. The question is therefore not simply whether a chemical appears somewhere in a bill of materials. You need the chemical, the product use, the route and level of exposure, and the business responsible for the exposure.

Businesses with fewer than 10 employees, government agencies, and public water systems are exempt from Proposition 65's warning requirement and discharge prohibition. OEHHA's regulations count full-time and part-time employees when applying that threshold. Marketplace contracts and other laws can still create separate obligations, so preserve evidence instead of treating the exemption as a substitute for review.

Use the OEHHA business guidance and Proposition 65 FAQs as starting points, then obtain legal advice for the specific product and exposure.

Online warning placement and wording must work together

For internet purchases, California's safe-harbor rules allow a compliant warning on the product display page, a clearly marked warning hyperlink on that page, or another prominent warning shown before the purchase is completed. A warning is not prominent when the shopper must search for it in general site content.

OEHHA's amendments took effect January 1, 2025 and give businesses using the older short-form warning three years to transition. The updated short form names at least one listed chemical and offers revised signal-word options. Products manufactured and labeled before January 1, 2028 may continue to use the older short-form content under the transition rule. Read the OEHHA amendment summary and final rule before changing live text.

  1. Identify the listed chemical and whether the concern is cancer, reproductive harm, or both.
  2. Confirm the exposure route and whether a warning is required.
  3. Select the applicable safe-harbor text or obtain counsel on an alternative warning.
  4. Place the online warning in the product purchase flow and coordinate packaging or label changes.
  5. Capture dated desktop and mobile screenshots after publication.

Treat a 60-day notice as a legal escalation, not a correction timer

A private enforcer generally must send a notice to the alleged violator and public prosecutors before filing a Proposition 65 action. The 60-day period gives designated government officials an opportunity to bring an enforcement action; it should not be confused with a guaranteed cure period for the seller.

On receipt, preserve the complete notice, envelope or delivery record, related ASINs, listings, supplier communications, tests, purchase orders, customs records, and marketplace messages. Limit speculative replies and ask qualified counsel to assess the notice, exposure theory, responsible parties, and response.

The California Attorney General publishes a 60-day notice search. A search result can help identify the filing, but it does not replace reviewing the served notice and the product evidence.

Product sample assessed against a chemical exposure threshold

Keep one evidence packet for every affected ASIN

  • Product identity: ASIN, SKU, model, batch, materials, variants, and packaging revision.
  • Supply chain: manufacturer, exporter, importer of record, distributor, and purchase orders.
  • Chemical evidence: declarations, certificates of analysis, lab reports, methods, and sample chain of custody.
  • Warning history: exact text, packaging artwork, listing fields, change log, and dated screenshots.
  • Import evidence: commercial invoice, packing list, entry documents, HTS classification, and country of origin.
  • Incident file: notices, platform communications, internal decisions, counsel instructions, and response dates.

Testing can support a decision, but the relevant question is exposure, not merely detection. Agree on the target chemical, sample plan, test method, and decision threshold before sending samples to a qualified laboratory. Keep the full report and the product version it covers.

Clear importer and customs records shorten the search

A freight forwarder does not decide whether a product needs a Proposition 65 warning. It can help keep the shipment record usable: who supplied the cargo, who acted as importer of record, what commercial documents traveled with the entry, and which batch moved on which shipment.

ForwarderOne coordinates DDP shipping from China to the USA, customs clearance, and final delivery for eligible shipments. Ask for a document handoff plan before pickup, and connect each shipment reference to the ASIN and batch records your compliance team maintains. Our TSCA import certification guide shows the same practical principle: product compliance and customs paperwork work best when ownership is explicit before cargo moves.

FAQ

Does a Prop 65 warning mean a product is unsafe or banned?

No. Proposition 65 is a right-to-know warning law, not a general product ban. A warning communicates an exposure to a listed chemical under the business's chosen compliance approach; it does not by itself quantify a consumer's risk.

Are small businesses exempt from Proposition 65?

OEHHA states that businesses with fewer than 10 employees are exempt from the warning requirement and discharge prohibition. Count and document employees carefully, and obtain advice about marketplace contracts or other obligations that may still apply.

Where should an online Prop 65 warning appear?

The safe-harbor methods place the warning, a clearly marked warning link, or another prominent warning in the product display and purchase flow before checkout is completed. The customer should not have to search general site content to find it.

What should an Amazon seller do first after receiving a 60-day notice?

Preserve the notice and delivery record, freeze relevant evidence, collect the affected ASIN and supply-chain documents, and consult qualified counsel before giving a substantive response.

Can a freight forwarder determine whether my product needs a warning?

No. Warning decisions require product, exposure, and legal analysis. A forwarder can help maintain shipment, importer, customs, and batch records that make the compliance review faster.

Keep your shipment records response-ready

Send ForwarderOne the supplier, cargo, importer, and delivery details before pickup. We can map the logistics documents and quote an eligible China-to-USA shipment while your compliance advisors handle product-specific warning decisions.
